Privacy Policy
This Privacy Policy explains how JoaoV Digital Business LLC ("JoaoV Digital", "we", "us") collects, uses, discloses and protects personal data, and what rights you have over that data. It applies to this website and to the online stores the company operates, except where a store publishes its own privacy notice, in which case that notice governs and this one supplements it.
1. Who we are
JoaoV Digital Business LLC is a limited liability company formed in 2025 in the State of New Mexico, United States, with its registered office at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States. For the purposes of the EU and UK General Data Protection Regulation, we act as the data controller for the personal data described in this policy.
You can reach us about any privacy matter at support@prkclothing.com.
2. The data we collect
We collect only what an online retail operation needs to take an order, deliver it and answer questions about it.
Data you give us
- Identity and contact data — name, e-mail address, telephone number, billing address and delivery address.
- Order data — the products you ordered, order value, currency, and any note or instruction you attach to the order.
- Correspondence — the content of e-mails, support messages and returns requests you send us, and our replies.
- Marketing preferences — whether you have consented to receive commercial e-mail, and any later withdrawal of that consent.
Data collected automatically
- Technical data — IP address, browser type and version, device type, operating system, language and time zone.
- Usage data — pages viewed, products viewed, referring page, and interactions with the store, collected through cookies and similar technologies as described in our Cookie Notice.
Data we receive from others
- Payment confirmations from our payment service providers — the result of the transaction, the payment method type and the last four digits of the card. We never receive or store your full card number, expiry date or security code.
- Shipping status from our logistics partners and carriers.
- Advertising and analytics measurements in aggregated or pseudonymised form from the advertising platforms we use.
We do not collect special categories of personal data (such as data on health, religion, political opinions, or biometric data), and we ask that you do not send such data to us.
3. Why we use it, and on what legal basis
| Purpose | Data used | Legal basis (EU/UK GDPR) |
|---|---|---|
| Taking, processing and delivering your order; issuing refunds | Identity, contact, order, payment confirmation | Performance of a contract |
| Customer support, returns and dispute handling | Identity, contact, order, correspondence | Performance of a contract; legitimate interests |
| Fraud prevention and payment security | Order, technical, payment confirmation | Legitimate interests; legal obligation |
| Accounting, tax and record-keeping | Order, identity, contact | Legal obligation |
| Improving our stores and measuring performance | Usage, technical | Consent (where cookies require it); otherwise legitimate interests |
| Marketing e-mail and personalised advertising | Contact, usage, marketing preferences | Consent, withdrawable at any time |
Where we rely on legitimate interests, that interest is running a solvent, secure retail operation and protecting it from fraud and abuse; we balance it against your rights and will stop the processing if you object and your objection outweighs it.
4. Who we share it with
We do not sell personal data, and we do not share it with anyone who is not necessary to fulfil the purposes above. Our recipients fall into these categories:
- Payment service providers — regulated, PCI DSS compliant processors who take the payment and handle chargebacks.
- E-commerce platform and hosting providers — the infrastructure our storefronts run on.
- Suppliers, fulfilment partners and carriers — who receive the delivery details needed to pick, pack and ship your order.
- Communication and support tools — e-mail and helpdesk providers used to reply to you.
- Analytics and advertising platforms — subject to your cookie choices.
- Professional advisers, auditors and authorities — where required by law, or to establish, exercise or defend legal claims.
All service providers act on our documented instructions under a written data processing agreement, and may not use your data for their own unrelated purposes.
5. International transfers
We are established in the United States and operate in Europe and the Americas, so personal data may be transferred outside your country of residence, including to the United States. Where we transfer personal data from the European Economic Area or the United Kingdom to a country without an adequacy decision, we rely on the European Commission's Standard Contractual Clauses (with the UK Addendum where applicable), together with additional technical and organisational safeguards. A copy of the relevant transfer mechanism is available on request.
6. How long we keep it
- Order and transaction records — kept for the period required by applicable tax and commercial law, ordinarily up to seven years from the transaction.
- Support correspondence — up to three years after the matter is closed.
- Marketing contact data — until you withdraw consent or after a prolonged period of inactivity, whichever comes first.
- Cookie and analytics data — for the lifetimes set out in the Cookie Notice.
When a retention period ends, data is deleted or irreversibly anonymised.
7. Your rights
If you are in the EEA or the United Kingdom
You have the right to request access to your personal data; to have inaccurate data corrected; to have data erased; to restrict or object to processing; to receive your data in a portable, machine-readable format; and to withdraw consent at any time without affecting processing already carried out. You also have the right to lodge a complaint with your national supervisory authority — for UK residents, the Information Commissioner's Office.
If you are in the United States
Depending on your state of residence, you may have the right to know what personal information we collect and disclose, to request its deletion or correction, to opt out of targeted advertising or the sale or sharing of personal information, and not to be discriminated against for exercising those rights. We do not sell personal information for money. Where our use of advertising cookies qualifies as "sharing" for cross-context behavioural advertising under state law, you can opt out through the cookie controls described in our Cookie Notice.
How to exercise a right
Write to support@prkclothing.com with the request and enough information to locate your records (for example the e-mail address used on the order). We answer within one month, and will tell you if we need to extend that period. There is no charge unless a request is manifestly unfounded or excessive. We may ask you to verify your identity before we act, so that we do not disclose your data to someone else.
8. Security
Our sites are served over TLS encryption. Access to customer data is limited to the people who need it to do their job and is protected by unique accounts and multi-factor authentication. Payment card data is handled entirely by our PCI DSS compliant payment providers and never touches our own systems. No method of transmission or storage is perfectly secure, but we maintain measures appropriate to the risk and review them periodically.
9. Cookies and tracking
Our use of cookies, pixels and similar technologies — including those used for advertising measurement — is described in the Cookie Notice, together with how to accept, refuse or later change your choices.
10. Children
Our stores are intended for adults. We do not knowingly sell to, or collect personal data from, children under 16 (or the higher age of digital consent in your jurisdiction). If you believe a child has provided us with personal data, contact us and we will delete it.
11. Changes to this policy
We may update this policy to reflect changes in our operations or in the law. The "last updated" date at the top always shows the current version. Where a change materially affects your rights, we will give notice by e-mail or by a prominent notice on the site before it takes effect.
